    Hilfiger Prevails in EU Trade Mark Clash

    The EUIPO’s Opposition Division has sided with Tommy Hilfiger, blocking attempt to register the mark TOM.NY UNDERWEAR across the EU. In a ruling delivered on 27 August 2025, the panel found that the contested sign bore too close a resemblance to Hilfiger’s existing 'TOMMY' word mark, particularly for identical goods in Class 25 such as underwear. Assessors noted that the contested brand’s distinguishing elements—such as 'NY', the dot, and the term "underwear" — lacked distinctiveness and did little to dispel the risk of consumer confusion. The Division concluded that English-speaking consumers, at minimum, would likely assume an economic link between the two brands.     Haribo Moves to Quash Indian 'Hari:Bol' Trademark in US

    German confectionery heavyweight Haribo has lodged an opposition in the United States against Indian firm Hari Haribol Dairy Products, challenging its mark 'HARI:BOL PURE FOOD FOR THE SOUL', which had been filed across a wide array of dairy, grain and packaged food categories. Haribo contends that the contested brand is close to its own world-famous HARIBO trademark, risking consumer confusion and brand dilution. The strength of the opposition was such that the application was almost immediately placed into cancellation pending status, signalling a decisive early blow for the claimant.
